What's Next?

Stephen Saloom, the state policy director of the National Association of Criminal Defense Lawyers, wrote a hopeful editorial, posted on Tallahasee.com

In response to remarks by conservative U. S. Supreme Court Justice Anthony Kennedy, the ABA formed a "Justice Kennedy Commission," assigning some of the nation's top attorneys to investigate and report on the health of the American correctional system. After a year of intensive research and hearings throughout the country, the commission's conclusions include:

• Repealing mandatory minimum sentences.

• Sentencing alternatives to incarceration as punishment for those who pose a low risk to society and appear likely to benefit from rehabilitative efforts.

• Providing appropriate programming, including substance-abuse treatment, educational and job-training opportunities, and mental-health counseling and services, from the beginning of each prisoner's incarceration.

• Limiting collateral sanctions of a conviction to those that are specifically warranted by the conduct underlying the conviction, and prohibit those that unreasonably infringe on fundamental rights or frustrate successful re-entry.

I'll have to do some further research to see where this currently stands with ABA.
